3. User Responsibility & Compliance (Extremely Important)

3.1 Content Responsibility

You assume full responsibility for all applications generated using ToApp and their content.ToApp is provided solely as a technical tool for web wrapping services and does not review, monitor, or control the content, functionality, legality, security, or suitability of generated apps.

You must ensure that:

• The target website content loaded by the generated app is fully legal and compliant
• You have the legal right to use the target website content or have obtained necessary authorization
• The generated app does not infringe on any third party intellectual property, privacy, or other legal rights
• The generated app complies with all applicable laws and regulations in your country/region and the target users country/region

3.2 Strictly Prohibited Activities

You are strictly prohibited from using ToApp to generate applications containing or linking to the following content:

• Illegal Content: Content that violates any national or regional laws and regulations, including but not limited to:
  • Pornographic, obscene, or vulgar content
  • Violent, gory, or terrorist content
  • Gambling, lottery, or illegal betting information
  • Drug, weapon, or other contraband trading information
  • Fraud, pyramid schemes, or illegal fundraising content
  • Content inciting hatred, discrimination, or violence
  • Content that compromises national security or public interest
• Infringing Content: Content that infringes on others intellectual property rights, including but not limited to:
  • Unauthorized use of others copyrighted works
  • Misappropriation or theft of others trademarks or brand identifiers
  • Content infringing on others patent rights or trade secrets
• Malicious Content: Content containing malicious code or harmful functionality, including but not limited to:
  • Viruses, trojans, worms, or other malware
  • Phishing or identity theft tools
  • Unauthorized data theft or surveillance programs
  • Code that damages computer systems
• Fraudulent Content: False, misleading, or fraudulent content, including but not limited to:
  • False advertising or false promotion
  • Impersonating official institutions or well-known enterprises
  • Spreading false information or rumors
• Privacy Violations: Content that collects, uses, or discloses others personal information without authorization

3.3 Legal Consequences

If you violate the above provisions:

• You will bear full legal liability and economic losses arising therefrom
• We have the right to immediately terminate your license to use the Software without any liability
• If your violation causes us to suffer losses, you shall provide full compensation
• We have the right to cooperate with law enforcement investigations and provide relevant evidence

4. Disclaimer & Limitation of Liability (Core Terms)

4.1 Software Provided "As Is"

ToApp is provided on an "AS IS" and "AS AVAILABLE" basis, without any express or implied warranties, including but not limited to:

• Warranty of merchantability
• Warranty of fitness for a particular purpose
• Warranty of non-infringement
• Warranty of error-free or uninterrupted operation
• Warranty of generated app quality or functionality

4.2 Complete Disclaimer for Generated Apps

ToApp is provided solely as a technical tool, and the developer assumes no responsibility for any applications generated by users using ToApp. This includes but is not limited to:

• Content Liability: No responsibility for the legality, authenticity, accuracy, or completeness of target website content loaded by generated apps
• Functionality Liability: No responsibility for the functionality, performance, compatibility, or stability of generated apps
• Security Liability: No responsibility for the security of generated apps, data security of target websites, or user privacy protection
• Compliance Liability: No responsibility for whether generated apps comply with app store rules, industry standards, or regional regulations
• Infringement Liability: No responsibility for copyright infringement, trademark infringement, patent infringement, or other intellectual property disputes that generated apps may involve
• User Losses: No responsibility for user data loss, device damage, economic loss, or reputational damage caused by using generated apps

Any legal disputes, administrative penalties, civil compensation, or criminal liability arising from generated apps shall be borne solely by the creator of the generated app (i.e., the user), and are unrelated to ToApp and its developer.

4.3 Disclaimer of Indirect Damages

To the maximum extent permitted by law, the ToApp developer shall not be liable for the following damages:

• Any indirect, incidental, special, punitive, or consequential damages
• Loss of profits, loss of revenue, business interruption
• Data loss, information leakage
• Goodwill damage, reputational loss
• Third-party claims or litigation costs

The above disclaimers apply even if the ToApp developer has been advised of the possibility of such damages.

4.4 Liability Cap

In any case, regardless of the legal theory (contract, tort, or otherwise), the total liability of the ToApp developer to you (if any) shall not exceed RMB 100.
